A Critical Study of Uṣūl al-Shāshī
One of the most essential disciplines within the Islamic sciences—yet often underrepresented in contemporary curricula—is uṣūl al-fiqh (legal theory). Following the successful introduction of a foundational primer in Ḥanafī uṣūl, Talweeh Academy is pleased to offer Level 2, dedicated to a rigorous and in-depth study of the classical text Uṣūl al-Shāshī.
Although widely taught across institutions, Uṣūl al-Shāshī is frequently introduced prematurely or approached through surface-level translation, often without sufficient critical engagement or broader methodological context. This course seeks to address these gaps by offering a structured, analytical, and comparative study of the text—aimed at unlocking its full scholarly potential.
What Makes This Course Unique
This is not a translation-based reading. Rather, it is a critical study and dissection of the text within its proper intellectual and juristic framework. Key features include:
- Cross-comparison with other major Ḥanafī uṣūl works
- A comparative study with the methodologies of uṣūl al-mutakallimīn
- Critical analysis of the examples and arguments presented in the text
- Expansion on essential topics that are often overlooked or insufficiently developed
Who is it for?
This course is intended for students who have successfully completed our Level 1 in Ḥanafī Uṣūl (or an equivalent program) and possess a foundational understanding of the Arabic language.
Those who have not yet completed Level 1 are advised to enroll in and finish the first level before proceeding to this course:
Learning Outcomes
By the end of the course, students will:
- Develop a strong command of the core discussions in Uṣūl al-Sāshī
- Understand the role of the text in shaping the Ḥanafī tradition of legal theory
- Recognize key methodological distinctions between the Ḥanafī approach and that of the jumhūr
- Analyze and articulate the underlying logical structures of uṣūlī principles
