Hanafi Uṣūl al-Fiqh (Level 01)

In this Lesson, Sheikh Omer delves into the intricate aspects of Islamic jurisprudence, focusing on the concepts of Ahkam Takleefiyah and Ahkam Wada’iyah. He explains that Ahkam Takleefiyah involves the imposition of actions upon individuals, such as the obligations and prohibitions set by Shariah. Sheikh Omer emphasizes the importance of understanding the legislative process of Shariah, which brings into existence various religious practices like Salah. He illustrates how these practices are not merely ritualistic but are deeply rooted in the divine commandments that define their parameters and guidelines. Through this lens, Sheikh Omer highlights the role of Shariah in shaping the religious realities that govern the lives of Muslims. Furthermore, the concept of Al-Hukm Al-Wad’i is explored, which refers to the rules and guidelines that determine the existence or non-existence of actions within the framework of Shariah. He uses the example of Salah to demonstrate how Shariah dictates the conditions and necessary elements for its validity. Sheikh Omer also discusses the significance of understanding the reasons behind the rulings, known as ‘Ilal, which are signs that guide the application of Shariah across different times and places. By doing so, he underscores the timeless and universal nature of Islamic law, which transcends cultural and temporal boundaries, ensuring its relevance and applicability in diverse contexts.
